1. Acceptance of These Terms
By creating an account, browsing listings, placing an order, listing an item,
providing delivery services, sending messages, receiving a payout, or otherwise
using Mavuno, you agree to these Terms of Service.
If you do not agree, you must not use the marketplace. Additional policies,
including the Privacy Policy, Security Policy, Seller Policy, Delivery Policy,
Escrow Policy, and Dispute Policy, form part of these terms where applicable.
2. Eligibility and Legal Capacity
- You must be legally capable of entering into binding transactions.
- You must provide accurate, current, and complete information.
- You must comply with all laws, permits, licenses, tax obligations, and industry rules that apply to your activity.
- You may not use Mavuno while suspended, banned, or legally prohibited from participating.
- Organizations must authorize the person creating or operating the account on their behalf.
3. Accounts and Security
- You are responsible for maintaining the confidentiality of your credentials.
- You are responsible for activity performed through your account unless you promptly report unauthorized access.
- You must not share accounts with unauthorized persons or create deceptive duplicate accounts.
- Mavuno may request identity, business, farm, driver, tax, banking, or ownership verification.
- Mavuno may reset credentials, terminate sessions, or restrict access where security concerns arise.
Never share your password, PIN, one-time code, or payment credentials with another user.
4. Mavuno’s Marketplace Role
Mavuno provides technology that helps users discover products and services,
communicate, place orders, arrange delivery, process payments, and resolve disputes.
Unless Mavuno is expressly identified as the seller or service provider, Mavuno is not
the owner, producer, manufacturer, transporter, warehouse operator, or direct supplier
of marketplace goods.
- Sellers are responsible for the legality, quality, safety, description, and fulfillment of their listings.
- Buyers are responsible for reviewing listing details and making informed purchasing decisions.
- Drivers and logistics providers are responsible for lawful, safe, and timely delivery services.
- Mavuno may facilitate transactions without becoming a party to the underlying sale.
5. Listings and Product Information
- Listings must be accurate, lawful, current, and placed in the correct category.
- Photos, descriptions, quantities, units, grades, prices, and locations must not be misleading.
- Sellers must disclose material defects, expiry dates, restrictions, treatment history, or safety information.
- Illegal, stolen, counterfeit, unsafe, recalled, or prohibited goods may not be listed.
- Mavuno may edit, reject, hide, suspend, or remove listings that create legal, safety, fraud, or policy risk.
6. Orders, Acceptance, and Fulfillment
An order is subject to seller acceptance, stock availability, payment authorization,
delivery feasibility, verification, and any marketplace review.
- Sellers must fulfill accepted orders according to the listing and agreed terms.
- Buyers must provide accurate delivery and contact information.
- Substitutions require buyer approval unless the marketplace clearly states otherwise.
- Mavuno may cancel orders affected by fraud, technical error, safety concerns, unavailable stock, or legal restrictions.
- Repeated cancellations or fulfillment failures may affect account standing.
7. Payments, Fees, Escrow, and Payouts
Users must use approved Mavuno payment methods for eligible marketplace transactions.
Transactions may be processed by third-party payment providers and may be subject to
verification, fraud review, limits, fees, and settlement rules.
- Mavuno may charge disclosed transaction, service, delivery, processing, withdrawal, or dispute fees.
- Funds may be held in escrow pending fulfillment, confirmation, review, or dispute resolution.
- Payouts may be delayed or withheld for verification, fraud prevention, refunds, chargebacks, or legal compliance.
- Users must not manipulate prices, payment references, transaction values, or settlement instructions.
- Off-platform payment arrangements may not qualify for Mavuno protection.

8. Delivery, Collection, and Logistics
- Delivery estimates are estimates unless expressly guaranteed.
- Users must provide safe, accurate, and accessible delivery or collection details.
- Sellers must package goods appropriately for their type, condition, and route.
- Drivers must comply with applicable licensing, vehicle, safety, and transport requirements.
- Perishable, livestock, chemical, and regulated goods may require special handling.
- Mavuno may reassign, delay, cancel, or investigate deliveries affected by safety, fraud, weather, access, or operational concerns.
9. Returns, Refunds, and Disputes
Buyers and sellers must cooperate in good faith when a product is missing, damaged,
unsafe, counterfeit, materially different, incorrectly measured, delayed, or not delivered.
- Users must submit disputes within applicable time limits.
- Users may be asked to provide messages, photos, invoices, delivery records, inspection evidence, or other documents.
- Mavuno may issue a full refund, partial refund, replacement, return instruction, payout release, or other reasonable remedy.
- Failure to respond may result in a decision based on available information.
- Fraudulent disputes or fabricated evidence may lead to account restrictions or termination.
10. Acceptable Use and Conduct
You must not:
- Commit fraud, deception, impersonation, harassment, discrimination, threats, or abuse.
- Use Mavuno to sell illegal, dangerous, counterfeit, stolen, or prohibited goods.
- Manipulate reviews, ratings, search placement, orders, referrals, or marketplace statistics.
- Send malware, phishing links, unsolicited marketing, or deceptive payment instructions.
- Attempt to access another user’s account, private data, payment information, or restricted systems.
- Scrape, copy, reverse engineer, disrupt, overload, or interfere with Mavuno systems without authorization.
- Use buyer, seller, driver, or employee information for unrelated purposes.
11. User Content and Intellectual Property
You retain ownership of content you submit, including listing text, photographs,
reviews, messages, and profile information, subject to rights granted under these terms.
- You grant Mavuno permission to host, display, reproduce, format, and use submitted content to operate and promote the marketplace.
- You must have the right to upload and use all content you submit.
- You must not infringe copyrights, trademarks, privacy, publicity, or other legal rights.
- Mavuno may remove content that is unlawful, misleading, harmful, infringing, or inconsistent with marketplace policies.
12. Monitoring, Restrictions, and Termination
Mavuno may review account activity, listings, messages, payments, delivery records,
complaints, verification documents, and other relevant information.
Mavuno may:
- Request verification, documents, corrections, or additional information.
- Limit messaging, listings, ordering, payouts, promotions, or other account features.
- Hold funds, cancel transactions, issue refunds, or remove listings.
- Suspend or permanently terminate accounts.
- Report suspected unlawful activity to payment providers, regulators, law enforcement, or affected parties.
Urgent safety, legal, fraud, or security concerns may require action without prior notice.
13. Disclaimers and Limitation of Liability
Mavuno provides the marketplace on an “as available” basis. While reasonable efforts are
made to maintain reliable services, Mavuno does not guarantee uninterrupted access,
error-free operation, product availability, user performance, delivery timing, or transaction outcomes.
- Users are responsible for evaluating products, sellers, buyers, drivers, and transaction risks.
- Mavuno is not responsible for indirect, incidental, special, or consequential loss to the extent permitted by law.
- Mavuno’s liability may be limited to the amount paid to Mavuno for the relevant transaction or service, where legally permitted.
- Nothing in these terms excludes rights or liabilities that cannot lawfully be excluded.
Consumer rights, statutory warranties, and mandatory legal protections continue to apply where required by law.
14. Indemnity
To the extent permitted by law, you agree to protect Mavuno and its affiliates,
officers, employees, contractors, and service providers from claims, losses, liabilities,
and expenses arising from your listings, products, services, conduct, legal violations,
misuse of the marketplace, or breach of these terms.
15. Governing Law and Legal Process
These terms are governed by the law stated in Mavuno’s registered business terms or the
law otherwise applicable to the transaction and user location. Users agree to cooperate
with lawful requests, court orders, regulatory inquiries, and required dispute procedures.
16. Changes to These Terms
Mavuno may update these terms to reflect legal, security, operational, payment,
marketplace, or feature changes. Updated terms become effective on the date published
unless another date is stated. Continued use after the effective date constitutes acceptance.
